An engineering study of the Texas Department of Criminal Justice’s (TDCJ) Boyd Unit water and wastewater facilities will be conducted by TRC Engineers, Inc. at the request of the City of Teague.

Aldermen voted unanimously on an addendum to the special called meeting to appropriate $17,500 from the City’s fund reserve account to conduct the study during their special called meeting Monday, October 29, 2018.

City Administrator/Secretary Theresa Prasil told the Council that the study is critical to their litigation against the City of Fairfield regarding enforcement of the Interlocal Definitive Agreement between the two cities to provide water and wastewater services to the prison.

Alderman Jerry Ballew asked Prasil if the City would be reimbursed for the cost of the study. Prasil answered that requests for reimbursement of such expenses would be included in the lawsuit against Fairfield.

“We have to do this if we want to move forward with litigation,” added Alderwoman Marilyn Michaud.

To date, Teague has filed a lawsuit against Fairfield alleging breaches of the Agreement and mismanagement of funds, asking for declaratory and injunctive relief.

Fairfield has provided their Original Answer to the civil suit, as well as a Motion to Dismiss; and a petition for a jury trial rather than the declaratory judgement requested by Teague, should the case be allowed to proceed.

In other business, the Council voted to appropriate $58, 532 from the fund reserve account to hire Layne Christensen Company to pull, inspect, and repair Well Number 3.

Alderman Ballew asked how long it has been since the well was last inspected. Prasil told him that documentation of the last inspection cannot be found.

Following a short executive session, the Council voted to hire Kyle Steen to the position of Public Works Technician for $12 per hour.
