A Motion for Change of Venue has been filed by attorneys for Dabrett Black, who stands accused of the November 2017 shooting death of Texas DPS Trooper Damon Allen.
According to reports, reasons for moving the trial out of Freestone County include the pervasive media coverage and a small population for jury pool.
Attorneys contend that seating a full jury of individuals without close knowledge of the incident would not be easy, denying the defendant’s right to a fair and impartial jury of his peers.
Defense attorneys had until Friday, February 15, 2019 to file the motion.
Now, prosecutors have until March 15th to respond.
Another pretrial has been tentatively scheduled for March 26th in 77th District Judge Patrick H. Simmons’ court.
