The Wrongful Termination and Racial Discrimination civil suit of Dianne Manning vs. Linda Jarvis, individually and in her official capacity as County Clerk of Freestone County, has been filed in the United States District Court for the Western District of Texas, Waco Division.
Mrs. Manning originally filed a Petition For Depositions Before Suit against Mrs. Jarvis on April 12th, and a hearing was scheduled for Wednesday morning, May 9th in the 87th District Court.
According to Manning’s Attorney, Chad Morgan, the case was moved to Federal Court in the Waco District following the receipt of a Right to Sue letter from the Equal Employment Opportunity Commission (EEOC).
“Typically it takes several months to get a response from the EEOC as to whether they want to be involved in a case or not,” says Mr. Morgan. “We actually received the Right to Sue letter after only a couple of weeks, so we have chosen to move the case to Federal Court.”
Both Manning and Jarvis have been advised not to comment on this case.
